“Plafonare”

Between January 1, 2023 and March 31, 2025, all customers benefit from the capping of the price of electricity and natural gas.

The new package of support measures complements GEO 27/2022, subsequently amended and supplemented by Law no. 357/2022.

In order to benefit from the facilities provided by the law, certain categories of non-domestic customers have the obligation to submit to the electricity supplier a request accompanied by a declaration on the personal responsibility of the legal representative.

ELECTRICITY

Based on the affidavit of the legal representative, the following thresholds of the capped final invoiced price apply as follows:

▹ Maximum 1 lei/kWh (VAT included), applies for 85% of the monthly consumption made at the place of consumption, the difference in monthly electricity consumption to be billed at a maximum price of 1.3 lei/kWh, (VAT included) for:

small and medium enterprises, as defined in Law no. 346/2004 regarding the stimulation of the establishment and development of small and medium-sized enterprises, with subsequent amendments and additions, hereinafter referred to as SMEs.

operators/regional operators defined in art. 2 lit. g) and h) from the Law on community services of public utilities no. 51/2006, republished, with subsequent amendments and additions, which renders/provides the public utility services provided for in art. 1 paragraph (2) lit. a), b), b^1), c) and h) from Law no. 51/2006, republished, with subsequent amendments and additions.

economic operators in the field of the food industry, identified by CAEN code 10, as well as those in the field of agriculture and fishing, identified by CAEN code 01 and 03.

local public authorities and institutions, decentralized public services of ministries and other central bodies, companies and commercial companies of county, municipal or local interest, autonomous governments and all public and private entities that provide a public service, under the law, if they are established or organized at the level of communes, cities, municipalities, counties, the municipality of Bucharest and, as the case may be, at the level of administrative-territorial subdivisions of municipalities or at the level of inter-community development associations, under the leadership, coordination a, control and responsibility of local public administration authorities.

national research and development institutes, as defined by Government Ordinance no. 57/2002 on scientific research and technological development, approved with amendments and additions by Law no. 324/2003, with subsequent amendments and additions.

public institutions, other than those provided for in art. 1 paragraph (1) lit. d) from GEO 27/2022, as well as for those belonging to cults officially recognized in Romania, according to Law no. 489/2006 on religious freedom and the general regime of cults, republished.

▹ Maximum 1 leu/kWh, including VAT, for the full consumption of:

public and private hospitals defined according to Law no. 95/2006 on health reform, republished, with subsequent amendments and additions

public and private educational units, defined according to the National Education Law no. 1/2011, with subsequent amendments and additions

nurseries, of public and private providers of social services provided for in the Nomenclature of social services, approved by Government Decision no. 867/2015 for the approval of the Nomenclature of social services, as well as the framework regulations for the organization and operation of social services, with subsequent amendments and additions

NATURAL GASES

▹ You benefit from the capped final price of a maximum of 0.37 lei/kWh (VAT included), in the case of non-domestic customers whose annual consumption of natural gas achieved in the previous year at the place of consumption is no more than 50,000 MWh, as well as in the case of thermal energy producers.

Starting from January 1, 2023, non-household customers in the industrial parks regulated by Law no. 186/2013 on the establishment and operation of industrial parks, with subsequent amendments and additions, as well as those within closed distribution systems defined according to Law no. 123/2012, with subsequent amendments and additions.

* The final invoiced price stipulated in art. 1 paragraph (2) lit. b) of GEO 27/2022 also applies to the consumption places of non-domestic customers connected in the respective year, within the limit of an annual consumption of no more than 50,000 MWh.”
